DECLARATIONS:

The signer of the digital document, herein referred to as "Purchaser", understands that by furnishing payment and clicking the "Proceed" button at the bottom of this form Purchaser agrees to the following terms, conditions, and statements:

SYSTEM DESCRIPTION:

Purchaser understands that myfreednc.com provides a Federal DNC scrubbing service which operates in the following way: Purchasers upload their list of phone numbers in .csv format to the website. The website compares each number in the Purchaser's .csv file against websites database to find a match. The file is returned to Purchaser after successful processed payment. The numbers not matching the Federal Do Not Call Registry database  will be downloaded in a .csv file format and the numbers that did match removed. Purchaser understands this action is performed against our database which was updated per the date listed on myfreednc.com at the time the purchase occurred.

AGREEMENTS MADE FROM PURCHASER:

Purchaser understands a purchase now does entitle them to future scrubs as the database is updated. Should a Purchaser want to update their list they must run an additional scrub at the pricing specified at that time.

Purchaser understands that all "scrubbing" services are to be performed after payment is received. Purchaser understands that scrubbing services are instant or near instant after payment is received in most cases.

Purchaser understands the automated system which provides this product is complex. On occasion the system processing may result in an error. In this case, the data provided by Purchaser will be manually reviewed and processed which may take longer. Purchaser agrees that should this occur on Purchases purchase, it does not qualify for a refund under any circumstances.

Purchaser agrees to submit files with a high data integrity. All phone numbers in the "phone" must be 10 or 11 digits and must not contain anomalies such as letters, illegal digits, blank values, or numbers less than or greater than 10 or 11 digits. Purchaser understands the system may charge for these columns and are not refundable. myfreednc.com charges on a "per row" basis, not a per qualified number basis.

Purchaser agrees to hold harmless myfreednc.com and it's owners, for any issues regarding, but not limited to, "the data quality, accuracy, or other data issues from the results file. myfreednc.com recommends that Purchaser double check the data quality of each file submitted.

GENERAL POLICY:

Purchaser understands that purchaser is "Scrubbing" data which applies only to the time and date of database update listed on myfreednc.com at the time of the purchase. Purchaser understands myfreednc.com makes no claim to the accuracy of it's data. While myfreednc.com testing shows it's data to consistently be 100% accurate, Purchaser agrees to verify these claims against any results Purchaser receives from myfreednc.com.

REFUND POLICY:

Purchaser understands the following are not acceptable terms for a refund or credit: Processing time, processing errors, data accuracy, delay or other reasons not explicitly stated below.

Purchaser understands the only acceptable reason for refund is failure of myfreednc.com to deliver data within 24 business hours after payment received.

PAYING BY CREDIT/DEBIT CARD:

Should Purchaser purchase products from myfreednc.com, Purchaser understands that while Purchaser is entitled to reverse, chargeback, or dispute any credit card charges per the cardholder and the merchant account holder agreement, Purchaser agrees that Purchaser is to fill out a myfreednc.com refund request/dispute form PRIOR to initiating any dispute for review by myfreednc.com and to confirm receipt of signed form in writing from myfreednc.com. Purchaser agrees to allow 10 business days for proper processing and investigation of said refund request dispute form before contacting any bank or credit card company.

LEGAL COMPLIANCE NOTICE:

myfreednc.com provides a scrubbing service against the Federal Do-Not-Call National Registry. Purchaser understands Purchaser is responsible for state DNC scrubbing which is not offered by myfreednc.com.

THIRD-PARTY REFERRAL (OPT-IN):

By using myfreednc.com, you agree to hereby allow myfreednc.com"to provide your contact information to third-party affiliates. To opt-out from this provision, you may email an opt-out request to unsubscribe@myfreednc.com.

COURT COSTS/ARBITRATION:

Should costs be incurred by either party to satisfy the terms of this Agreement, the prevailing party shall be entitled to reasonable reimbursement, including any expenses of litigation and reasonable attorney's fees. Attorneys" fee award shall not be computed in accordance with any court fee schedule, but shall be such as to fully reimburse all attorneys" fees reasonably incurred in good faith. The invalidity of any provision of this Agreement as determined by a court of competent jurisdiction shall in no way affect the validity of any other provision hereof. This agreement shall be governed and be subject to the laws of the State of Florida.
